Policy Summary
This document is a summary
of the Aircrew Legal Protection insurance product and provides
details of the main benefits and limitations of the insurance. The
summary does not contain the full terms, exclusions and conditions
of the insurance policy which can be found within the policy
document.
Aircrew Legal Protection is a Legal Expenses
insurance policy to provide cover to individuals who are employed
as air crew, licensed aircraft engineers or air traffic
controllers against Legal Expenses incurred arising out of claims
or legal proceedings in respect of this activity.
The
insurance policy is a claims made insurance, which means it will
only respond to claims or matters that could give rise to a claim
involving you and which you notify to the insurer in writing
during the period of insurance stated in the schedule attaching to
the insurance policy.
The application form that you
complete will state what limits are available to purchase for this
insurance. Depending on what limit you decide to purchase this
will be specified in the schedule attaching to the insurance
policy and the insurer will pay up the maximum amount stated for
any one claim and the overall aggregate for all claims notified
during the period of the insurance policy.
Legal Expenses
include any fees, expenses and other disbursements reasonably
incurred by the solicitor that will represent you in any claim
under the insurance policy
The insurer is Brit Insurance
Limited and the insurance has been arranged for you through
Aircrew Legal Protection Limited. Aircrew Legal Protection Limited
is the agent of the insurer and has the authority from the insurer
to provide you with the Aircrew Legal Protection insurance policy
and to make decisions on the insurer's behalf in the
administration of the insurance. Your Aircrew Legal Protection
insurance policy will be issued direct to you by Aircrew Legal
Protection Limited.
Brit Insurance Ltd and Aircrew Legal
Protection Ltd are authorised and regulated by the Financial
Services Authority.
Significant Features and
Benefits
The Aircrew Legal Protection insurance policy
provides you with cover for the payment of Legal Expenses relating
to the following situations which arise as a result of your
employed activity as a pilot or other aircrew member:

Representation at an enquiry established by a statutory authority
concerned with administration, management, education or training
which you are required or requested to attend. * Representation
at a public or private hearing held by a government authority into
any accident or occurrence in relation to any aircraft in which
you may be involved. * The defence of a claim made against you
arising out of and in the course of your employment. * The
pursuit of any claim against your employer. * The pursuit of
your legal rights against a third party in civil law to obtain
compensation due to any injury you have suffered.
A
benefit of the Aircrew Legal Protection insurance policy is a 24
hour 365 days a year Telephone Legal Helpline service provided by
the insurer. You will be provided with the telephone number and
information on what details to quote in order to access this
service within the insurance policy. The service is provided
within the insurance premium you have paid other than the cost of
the telephone call.
Significant Exclusions or
Limitations
The full list of all exclusions are as
stated under the heading "Exclusions" within the
insurance policy. The significant exclusions applicable to the
insurance and for which cover is not provided are as follows (the
numbers shown relate to the numbers within the insurance policy):
1. The defence of any civil legal proceedings arising from;
(a)
Death or injury to any person including sickness, disease or any
naturally occurring condition or degenerative process except in
relation to the cover provided under the significant features and
benefits stated above.
(b) Loss, destruction or damage to
property owned, occupied or under the control of a third party,
except in relation to the cover provided under the significant
features and benefits.
3. Legal Expenses incurred before
the Claims Administrator consent has been granted in writing.
4.
Any claim in connection with or arising from any cause, event or
circumstance occurring prior to or existing at the inception of
the insurance policy which you knew or ought reasonably to have
known may give rise to a claim or legal proceedings by or against
you.
11. Legal Expenses in connection with Judicial Review
or reference to the European Court of Justice.
16. Any
claims or legal proceedings in respect of representation at any
Service Board of Inquiry or Court Martial.
17. Any claims
or legal proceedings relating to the flying of any aircraft
outside the course of your employed activity as a pilot or aircrew
member.
Condition 4.3 of the full insurance policy requires there to be
reasonable prospects of a successful defence or pursuit of any
claim under this insurance.
The duration of the
insurance policy
The insurance policy will normally be
for a period of 12 months. The schedule attaching to the policy
wording will state the actual period of insurance.
The
price of the insurance policy
The premium applicable
will be as stated on the application form and will depend on the
limit that you decide to purchase. Insurance premium tax at the
rate prevailing at the time will be charged in addition to the
premium.
How to make a claim
All claims
under this insurance are handled on behalf of the insurer by their
Claims Administrator, ARAG plc
You must notify the Claims
Administrator in writing immediately you are aware of any cause,
event or circumstance which has or could give rise to a claim or
legal proceedings which involves you. This policy only covers
claims notified in writing to the Claims Administrator during the
period of insurance as stated in the schedule attaching to the
insurance policy. A claim form will be sent to you, and you must
complete and return this form immediately.
The Claims
Administrator must agree all claims in writing before any Legal
Expenses are to be incurred. Only Legal Expenses which the Claims
Administrator has expressly agreed to will be covered by this
insurance.

Your
right to cancel
You have the right to cancel the
Aircrew Legal Protection insurance policy within 14 days of the
date of you receiving the insurance policy document with a full
refund of the premium.
To
exercise your right to cancel please give written notice to
Aircrew Legal Protection Ltd.
Compensation
The insurer is covered by the Financial Services
Compensation Scheme ("FSCS"). You may be entitled to
compensation from the scheme if the insurer cannot meet its
obligations. This depends on the type of business and the
circumstances of the claim. Further information about compensation
scheme arrangements is available from the FSCS.

Jurisdiction
This policy shall be governed
by and construed in accordance with the laws of England and Wales.
If you have a complaint
The insurer is
committed to providing a first class service at all times. If,
however, a complaint arises, then this should be addressed in the

If a complaint remains unresolved,
you may request that the Financial Ombudsman Service review the
case provided that the complaint falls within its jurisdiction.
The Financial Ombudsman Service can normally deal with complaints
from private individuals and small businesses with an annual
turnover of less than £1 million (for a group of companies, this
means a group annual turnover of less than £1 million). The
Financial Ombudsman Service can also help with complaints from
charities with an annual income of less than £1 million, and from
